  • Any errors, omissions, or inaccuracies in content

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SITE SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, WHICHEVER IS GREATER.

Some jurisdictions do not allow limitation of liability for certain damages, so some limitations may not apply to you.

15. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY – IT AFFECTS YOUR LEGAL RIGHTS

Informal Resolution: Before filing any claim, you agree to contact us at neal@thepointspreneur.com to attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration: If informal resolution fails, you agree that any dispute arising from these Terms or your use of the Site will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

  • Arbitration will be conducted in Marin County, California, or remotely via video conference
  • Each party will bear its own costs and fees
  • The arbitrator’s decision will be final and binding
  • You waive your right to a jury trial
  • You waive your right to participate in class actions

Exceptions: Either party may seek injunctive relief in court to protect intellectual property rights or prevent unauthorized use of the Site.

30-Day Opt-Out Right: You may opt out of arbitration by sending written notice to neal@thepointspreneur.com within 30 days of first accepting these Terms. If you opt out, disputes will be resolved in the state or federal courts located in Marin County, California.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. If you opt out of arbitration, you consent to the exclusive jurisdiction of state and federal courts in Marin County, California.

17. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after changes constitutes acceptance of the modified Terms. Material changes will be noted with an updated “Last Updated” date.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, Affiliate Disclosure, and any Professional Services Agreement, constitute the entire agreement between you and The Points Preneur regarding your use of the Site.

20. Termination

We reserve the right to terminate or suspend your access to the Site at any time, without notice, for any reason, including violation of these Terms.

Upon termination:

  • Your right to use the Site immediately ceases
  • Sections that by their nature should survive (Limitation of Liability, Indemnification, Governing Law) remain in effect
  • You remain liable for any obligations incurred before termination

21. No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
